Important Notice: By using the Unreal Protect website and services, you agree to these Terms of Service. If you do not agree to these terms, please do not use our services. For minors, a parent or guardian must review and accept these terms on your behalf.

These Terms of Service ("Terms") govern your use of the Unreal Protect website and related informational services (collectively, the "Services") operated by Epic Games, Inc. ("Epic," "we," "us," or "our"). These Terms are a legal agreement between you and Epic Games.

1. Overview of Services

Unreal Protect is an informational website designed to educate Unreal Engine developers about intellectual property (IP) protection services available through the Unreal Engine Developer Portal. The Services include:

  • Information about IP protection and enforcement programs
  • Educational content about DMCA takedowns and cease-and-desist procedures
  • Links and access to the Unreal Engine Developer Portal for submitting infringement reports
  • Resources and guidance for protecting your creative works

Note: Actual infringement reports and DMCA submissions are processed through the Unreal Engine Developer Portal, which is subject to its own terms and conditions.

2. Eligibility

To use the Services, you must:

  • Be at least 18 years of age, or have parental/guardian consent if you are a minor
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law
  • Have a valid Epic Games Account to access the Developer Portal features

3. Epic Games Account

To submit infringement reports through the Developer Portal, you must have an Epic Games Account. Your use of an Epic Games Account is subject to the Epic Games Terms of Service. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information
  • Notifying Epic immediately of any unauthorized use of your account

4. Intellectual Property Protection Services

The Unreal Protect program is designed to help Unreal Engine developers protect their creative works. When using our IP protection services, you agree to:

  • Only submit reports for intellectual property that you own or are authorized to protect
  • Provide accurate and truthful information in all infringement reports
  • Understand that false or misleading reports may result in account suspension
  • Comply with all applicable laws regarding intellectual property claims
  • Not abuse the reporting system for competitive or malicious purposes

5. DMCA and Takedown Procedures

Epic Games complies with the Digital Millennium Copyright Act (DMCA) and similar international intellectual property laws. When submitting a DMCA takedown request, you must:

  • Identify the copyrighted work that has been infringed
  • Identify the infringing material with sufficient detail for Epic to locate it
  • Provide your contact information
  • Include a statement that you have a good faith belief that the use is not authorized
  • Include a statement, under penalty of perjury, that the information in your notice is accurate
  • Provide your physical or electronic signature

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.

6. Acceptable Use

When using the Services, you agree not to:

  • Submit false, fraudulent, or misleading infringement reports
  • Impersonate any person or entity
  • Use the Services to harass, abuse, or harm others
  • Attempt to gain unauthorized access to any portion of the Services
  • Use automated systems or software to extract data from the Services
  • Interfere with or disrupt the Services or servers
  • Violate any applicable laws or regulations

7. Intellectual Property Rights

The Services and all content, features, and functionality are owned by Epic Games, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Unreal Engine, Unreal, the circle-U logo, Epic Games, and the Epic Games logo are trademarks or registered trademarks of Epic Games, Inc. in the United States and elsewhere.

8. Privacy

Your privacy is important to us. Our collection and use of personal information in connection with the Services is described in the Epic Games Privacy Policy. By using the Services, you consent to our collection and use of your information as described therein.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. EPIC GAMES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Epic does not guarantee the success of any infringement report or takedown request. The outcome of IP enforcement actions depends on various factors including the nature of the infringement and applicable laws.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EPIC GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Epic Games and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Services or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the Epic Games Terms of Service, except where prohibited by law.

13. Changes to Terms

Epic Games reserves the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any changes indicates your acceptance of the modified Terms.

14. Termination

Epic Games may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms of Service are supplemental to the Epic Games Terms of Service. In the event of any conflict between these Terms and the Epic Games Terms of Service, the Epic Games Terms of Service shall prevail.
